The marriage of Alhaji Musa Tsafe and his granddaughter, Wasila Isah Tsafe, was forcibly dissolved by the Higher Shari’a court in the Tsafe area of Zamfara State.
In an interview with Journalist, Tsafe explained that the problem began when another member of the same family wanted to marry one of their relatives, but the family members rejected the idea outright because they were blood relatives.
According to him, the man who planned to marry one of his relatives saw an example of him (Tsafe) marrying his relation and wondered why his own marriage should not be approved by the same family members.
“As a result, our relatives invited me, demanding that the marriage be annulled because we are blood relatives, claiming that they made mistakes in accordance with Islamic injunctions regarding marriage rules.”
“My wife, Wasila, and I both rejected the idea because our marriage has produced eight children and we live in peace.”
“The marriage was officiated by an Islamic scholar who had no idea the marriage was against Islamic teachings until now.” If there is a mistake in the marriage, the family members and the Islamic scholar should be held accountable.
“We’ve been married for over 23 years, have eight children, and live happily ever after.” Then how could some people intervene to end a happy marriage that has lasted more than two decades?
“We must appeal the judgment at the State Shari’a Court of Appeal because we are dissatisfied with the judgment of the Higher Shari’a court,” he explained.
Alhaji Usman Isah, a relative of Alhaji Tsafe, told DAILY POST that when the family members presented the issue of dissolving the marriage between Alhaji Tsafe and Wasila, (his wife), they moved from Tsafe town to a village within the Tsafe Local Government Area.
“When pressures mounted on them, Alhaji Tsafe relocated to Kaduna State with his family, staying for several years before returning to Tsafe, believing that the tension had subsided.”
“When the community members saw him in Tsafe, they raised an alarm, forcing the family members to take the case to Tsafe emirate council, who invited the Hisbah commission to investigate the marriage and report back,” he added.
According to Isah, the Hisbah commission investigated the marriage and submitted their report to the emirate council, advising that the council should involve the State Islamic Advisory committee, pointing out that when the Advisory committee submitted its report, it tallied with the report of Hisbah commission.
“The emirate council then invited both the couple and their large family and advised that the marriage be annulled, but Alhaji Tsafe and his wife insisted on remaining together.”
“The emirate council had already provided a completed building for Wasila and her eight children to live in, and Alhaji Musa Tsafe had been instructed to release money to them for their upkeep,” he added.
He went on to say that when all of their efforts failed, the commission had no choice but to take the case to the Higher Shari’a court in Tsafe and seek the dissolution of the marriage.
